Divorcing Your Spouse Even When They Cannot Be Found

One problem that sometimes occurs when you get married young is that you haven't fully grown and matured. After spending a few years as a married couple, your partner might suddenly disappear. They pack up their belongings in the middle of the night and you have no idea where they have headed off to. You might then wonder how you can get a divorce.

Divorce Is Expensive

Getting married can be a quick and simple process. All you have to do is go to the courthouse and sign a piece of paper. However, the process of getting divorced is more complicated and is especially difficult when your partner cannot sign divorce papers or reach any agreements that would make your divorce faster and less expensive.

You Can Dissolve Your Marriage Without Your Spouse

You will need to file a petition for the dissolution of your marriage. You will then be given a case number and you will be able to forward with getting divorced. Then, you will need to inform your partner that you are divorcing them. This is where your divorce can become more complicated. However, you will be able to speed up your divorce if you are proactive.

Try to Find Your Spouse

First, you will need to make a diligent effort to find your ex-spouse. This might involve hiring a private investigator. You may hire a process server to serve your ex their divorce papers and they might work with a private investigator.

Contact a Newspaper

When you are not able to find your ex, they still have the right to be informed that they are being served. Fortunately, you have another option known as a service through publication. This means that you will be serving your ex through a newspaper that has the printed divorce proceeding. This should be in a newspaper that you think is likely for your ex to read.

File the Appropriate Motions

The judge will need to be convinced that the service through publication is acceptable after you file the motion. Once the notion has been filed, you will need to wait several days based on the state in which you reside. Then, you will be able to move forward with your divorce.

It's important to make sure that you work with a divorce lawyer through this process. They will make sure that you do everything correctly so that the motions you file are approved and so that your divorce can then be finalized. Speak to a local divorce lawyer to learn more.
